ПРАВИЛА СООБЩЕСТВА
и допустимое использование сервиса Ladoni Music
(Acceptable Use Policy)

Настоящие Правила сообщества и допустимого использования (далее — «Правила») определяют, какой контент и какое поведение допустимо в Сервисе Ladoni Music, и какие меры применяются к нарушителям.
Правила являются неотъемлемой частью Публичной оферты и обязательны для всех пользователей. Использование Сервиса означает безоговорочное согласие с настоящими Правилами. Термины имеют те же значения, что и в Публичной оферте.
В Сервис запрещается загружать Объекты, содержащие или представляющие собой:
2.1. Пользователю строго запрещены любые действия, направленные на искусственное завышение показателей использования Объектов, в том числе:
2.2. Оператор использует собственные системы выявления фрода, а также получает информацию о нарушениях от Онлайн-сервисов, ОКУП и третьих лиц.
3.1. При выявлении подозрений на нарушение настоящих Правил Оператор вправе:
3.2. Информация, полученная от Онлайн-сервисов о фроде, как правило, является достаточным основанием для применения санкций без дополнительного расследования. Оператор не обязан раскрывать Пользователю детали внутренних алгоритмов выявления фрода Онлайн-сервисов.
4.1. При подтверждении нарушения Оператор вправе применить одну или несколько из следующих санкций:
4.2. Применение санкций не освобождает Пользователя от обязанности возместить Оператору убытки, превышающие удержания, в полном объёме.
4.3. Применение санкций не подлежит обжалованию во внутренней процедуре, кроме случаев, когда Пользователь предоставит документально подтверждённые доказательства отсутствия нарушения. Срок рассмотрения обжалования — 30 (тридцать) календарных дней. Возможность судебного обжалования сохраняется в полном объёме.
5.1. Все Релизы перед отправкой в Онлайн-сервисы проходят модерацию Оператора.
5.2. Оператор вправе:
5.3. Сроки модерации обычно составляют до 5 (пяти) рабочих дней. Оператор не гарантирует прохождение модерации к конкретной дате выхода Релиза.
6.1. Использование AI-инструментов Сервиса для генерации обложек и промоматериалов допускается в соответствии с разделом 5 Публичной оферты.
6.2. Загрузка AI-сгенерированного аудио (фонограмм, созданных с использованием AI) допускается только в том случае, если Пользователь:

7.1. Оператор вправе изменять настоящие Правила. Новая редакция размещается на сайте ladoni.ru.
7.2. Уведомление об изменениях направляется через Личный кабинет и/или по e-mail не позднее чем за 14 (четырнадцать) календарных дней до даты вступления изменений в силу, за исключением случаев, когда изменения направлены на пресечение нарушений или приведение Правил в соответствие с законом — такие изменения вступают в силу немедленно с момента публикации.

These Community Rules and Acceptable Use Policy (hereinafter — "Rules") define what content and conduct is permitted in the Ladoni Music Service, and what measures apply to violators.
The Rules form an integral part of the Public Offer and are binding on all users. Use of the Service constitutes unconditional acceptance of these Rules. Terms have the same meanings as in the Public Offer.
It is prohibited to upload to the Service Objects that contain or consist of:
materials that infringe the copyright and neighbouring rights of third parties, including without proper licenses for samples, covers, remixes;
materials that infringe the rights of third parties to use names, voices, images, trademarks, and other means of identification;
extremist content, incitement to violence, incitement to hatred and enmity on any grounds;
sexually explicit material involving minors in any form;
materials that promote or facilitate the commission of crimes;
content that violates the legislation of the Russian Federation and/or the laws of countries where distribution takes place;
content expressly prohibited by the regulations of Online Services.
2.1. Users are strictly prohibited from taking any action aimed at artificially inflating the usage metrics of Objects, including:
stream manipulation using click-farm services, bots, scripts, device farms;
download, follower, like, and playlist-save manipulation;
purchasing fake streams and other fake activity through any services and platforms;
organized self-streaming of Objects on specially created accounts to inflate metrics;
use of VPNs, proxy services, and other means to conceal manipulation;
mass uploading of low-quality, templated content (AI-spam): tracks of approximately 30 seconds, series of identical tracks generated without artistic intent and designed to manipulate payouts;
uploading content containing silence, white noise, or technical audio that does not meet the criteria of a musical work;
repeated uploading of the same or nearly identical Objects under different titles, under different artist names, for the purpose of manipulating Online Service algorithms;
sharing login credentials with third parties to circumvent Service restrictions.
2.2. The Operator uses its own fraud detection systems and receives information about violations from Online Services, CMOs, and third parties.
3.1. Upon detecting suspected violations of these Rules, the Operator may:
commence an internal investigation, including using data from Online Services;
suspend the distribution of disputed Objects during the investigation;
freeze remuneration accrued for disputed Objects pending the conclusion of the investigation;
request explanations and supporting documents from the User; the User's response deadline is 10 (ten) calendar days.
3.2. Information received from Online Services about fraud generally constitutes sufficient grounds for applying sanctions without further investigation. The Operator is not obliged to disclose to the User the details of Online Services' internal fraud detection algorithms.
4.1. Upon confirmation of a violation, the Operator may apply one or more of the following sanctions:
withholding from the User's remuneration the full amount deemed fraudulent by the Online Service;
withholding from the User's remuneration (including from remuneration for other, unchallenged Objects in the User's Catalog) the amount of fines, deductions, and other sanctions imposed by Online Services or CMOs on the Operator in connection with the User's Objects;
removal (withdrawal) of the relevant Objects from distribution in Online Services;
temporary blocking of the User's Account (in whole or in part);
permanent blocking of the User's Account (ban);
unilateral termination of the license agreement without payment of remuneration for the fraud period;
adding the User to an internal register of bad-faith users and refusing further registration in the Service;
referral of information about the violation to law enforcement — in cases expressly provided for by law.
4.2. The application of sanctions does not release the User from the obligation to fully compensate the Operator for losses exceeding the deductions.
4.3. Sanctions are not subject to internal appeal, except where the User provides documentary evidence of the absence of a violation. The appeal review period is 30 (thirty) calendar days. The right to judicial appeal is fully preserved.
5.1. All Releases undergo Operator moderation before submission to Online Services.
5.2. The Operator may:
reject a Release where it does not meet the requirements of Online Services or these Rules;
request additional documents from the User confirming rights to Objects, samples used, consents to images, lyrics, etc.;
remove an already published Release from distribution upon discovery of violations;
require removal of specific elements of a Release (artwork, metadata, tracks) that violate the rules;
refuse distribution without disclosing detailed reasons, if disclosure would breach confidentiality obligations to Online Services.
5.3. Moderation typically takes up to 5 (five) business days. The Operator does not guarantee that moderation will be completed by a specific Release date.
6.1. Use of Service AI tools for generating cover artwork and promotional materials is permitted in accordance with Section 5 of the Public Offer.
6.2. Uploading AI-generated audio (sound recordings created using AI) is permitted only if the User:
holds all necessary rights to the generated audio and the materials used in its generation;
discloses the use of AI in the Release metadata, where required by Online Service regulations;
does not violate the prohibition on AI-spam set out in Section 2 of these Rules.
6.3. Uploading AI-generated audio that imitates the voice of a specific performer without their consent is prohibited.
7.1. The Operator may amend these Rules. A new version is published at ladoni.ru.
7.2. Notice of changes is sent through the Personal Account and/or by email no later than 14 (fourteen) calendar days before the effective date, except where changes are intended to prevent violations or bring the Rules into compliance with law — such changes take effect immediately upon publication.
